The terms governing your use of our will creation service

Introduction

These Terms of Service govern your use of the WUHLD will creation platform. By using our service, you agree to these terms in full. If you disagree with any part of these terms, please do not use our service.

WUHLD is NOT a law firm and does NOT provide legal advice. We provide a document generation tool to help you create a will template.

While our will templates are designed to comply with UK law, we strongly recommend having your completed will reviewed by a qualified solicitor before signing, especially if:

  • Your estate is complex or valuable
  • You have international assets or beneficiaries
  • You have concerns about potential disputes
  • You have dependents with special needs
  • You are uncertain about any aspect of your will

WUHLD cannot guarantee that a will created through our platform will be suitable for your specific circumstances or will be deemed valid in all legal proceedings. You use our service at your own risk.

Regulatory Status and Legal Services Act 2007

Document Assembly Service

WUHLD operates as a document assembly and generation service. We provide technology that enables you to create your own will documents using our templates and guidance materials.

What We Do:

  • Provide software tools for document creation
  • Offer standardized will templates based on common UK legal formats
  • Provide general guidance on will execution requirements under UK law
  • Enable you to input your own information to generate a personalized document

What We Do NOT Do:

  • Provide legal advice or recommendations specific to your circumstances
  • Conduct legal analysis of your estate or family situation
  • Act as your solicitor, legal representative, or adviser
  • Engage in any reserved legal activities as defined by the Legal Services Act 2007
  • Review or verify whether our templates are appropriate for your specific situation

Legal Services Act 2007 Compliance:

Under the Legal Services Act 2007, certain legal activities are "reserved" and can only be performed by authorized persons. will-writing in England and Wales is generally not a reserved legal activity, which means it is not restricted to solicitors and authorized practitioners.

However, WUHLD goes further by operating strictly as a document assembly tool rather than a will-writing service. We do not draft wills for clients based on instructions, advise on content or structure, or make decisions on your behalf about estate planning.

Your Responsibility: You are responsible for determining whether our document assembly service is appropriate for your needs. If you require legal advice, estate planning guidance, or have a complex situation, you must consult with a qualified solicitor who is authorized to provide legal advice under the Legal Services Act 2007.

Our Service

WUHLD provides an online platform for creating legally binding wills in the United Kingdom. Our service includes:

  • Guided Questionnaire: A comprehensive questionnaire to collect information for your will
  • Document Generation: Generation of a will document based on your responses
  • Signing Instructions: Instructions for properly signing and witnessing your will
  • Secure Storage: Secure storage of your will information in your account

Important: WUHLD is a document generation tool only. You review a complete preview of your will before payment, and you are responsible for ensuring it meets your needs. The legally binding will is the physical document you print, sign, and witness according to UK law - not the digital file we provide.

Legal Validity of Wills

Wills created through WUHLD are designed to be legally valid in the United Kingdom when properly executed. For a will to be legally binding, it must be:

  • Signed by you (the testator) in the presence of two witnesses
  • Signed by two witnesses in your presence
  • The witnesses must be over 18 and not beneficiaries of the will (or married/civil partnered to beneficiaries)

WUHLD provides clear instructions for properly executing your will, but the responsibility for correct execution lies with you. An improperly executed will may not be legally valid.

Eligibility and User Responsibilities

Eligibility Requirements

To create a will through WUHLD, you must:

  • Be at least 18 years of age
  • Be of sound mind and mental capacity
  • Not be acting under duress or undue influence
  • Provide accurate and complete information

Your Responsibilities

By using our service, you acknowledge and agree that:

  • Accuracy: You are solely responsible for the accuracy and completeness of all information you provide. Errors in your information may result in an invalid or unsuitable will.
  • Suitability: You are responsible for determining whether our service is appropriate for your circumstances. We do not assess the complexity of your estate or provide guidance on whether you need professional legal advice.
  • Review: You must carefully review your will before payment and signing. You have the opportunity to preview your complete will before purchasing.
  • Execution: You are responsible for properly executing (signing and witnessing) your will according to UK law. We provide instructions, but cannot verify that you have followed them correctly.
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Payment and Fees

WUHLD charges a one-time fee of £49.99 for our will creation service. This fee includes:

  • Access to our guided will creation questionnaire
  • Generation of your personalized will document
  • Complete preview before payment
  • PDF download of your will
  • Secure storage in your account
  • Ability to edit and re-download

There are no hidden fees, subscriptions, or recurring charges. Payment is a one-time fee.

Payments are processed securely through Stripe, our PCI DSS compliant payment provider. We do not store your credit card details. By making a payment, you confirm that you are authorized to use the payment method provided.

Refund Policy

One-Time Payment for Lifetime Access

WUHLD charges a one-time payment of £49.99 for lifetime access to create and update unlimited wills. There are no hidden fees, subscriptions, or recurring charges.

14-Day Money-Back Guarantee

You may request a full refund within 14 days of payment, provided you have not downloaded any will documents (will, guides, or estate information). Simply email hello@wuhld.com with your account email address. No questions asked.

After First Download

Once you download any document for any of your wills, the cancellation right ends. This is because:

  • You previewed your complete will before payment
  • You agreed to immediate delivery of digital content
  • You received the service you paid for

Exceptions (Refunds After Download)

We will provide a full refund even after download if:

  • Our software contains an error that produces an incorrect document
  • Technical issues prevent you from accessing your account or documents
  • You were charged incorrectly or charged multiple times

Non-Refundable Situations

Refunds will not be provided for:

  • Change of mind after downloading any documents
  • Errors in information you provided during will creation
  • Determination that your situation requires professional legal advice
  • Improper execution (signing/witnessing) of your will
  • Dissatisfaction with standard legal terminology or formatting

Consumer Rights (Consumer Contracts Regulations 2013)

Under UK law, you have the right to cancel digital content purchases within 14 days. However, by completing payment after previewing your will, you:

  • Agree to immediate delivery of digital content (your will PDFs)
  • Acknowledge that your right to cancel ends once you download any document
  • Understand that you reviewed the complete will before payment

Important: Before purchasing, you have full access to preview your complete will. We strongly encourage you to review it carefully before payment. To request a refund, email hello@wuhld.com with your account details. Refunds are typically processed within 5-10 business days.

Intellectual Property

The WUHLD platform, including all content, features, and functionality, is owned by WUHLD Ltd and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of our platform without our explicit permission.

The will document created through our service is your property once payment is completed. You may use, print, and distribute it as needed for your personal estate planning purposes.

Professional Indemnity Insurance

WUHLD maintains professional indemnity insurance to protect both our business and our customers in the event of errors or omissions in our service. However, this insurance does not replace the need for you to carefully review your will and, where appropriate, seek professional legal advice.

Limitation of Liability

Exclusions

Nothing in these terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any matter for which it would be illegal for us to exclude or limit our liability

Limitation of Damages

To the extent permitted by law, WUHLD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our service, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.

Cap on Liability

Subject to the exclusions above, our total aggregate liability to you for any and all claims arising from your use of our service shall not exceed £10,000 (ten thousand pounds). This limitation applies regardless of the legal theory under which liability is claimed and whether such claims arise in contract, tort (including negligence), statute, or otherwise.

No Guarantees

While we strive to ensure the accuracy of our will templates and guidance, we cannot guarantee that a will created through our service will be suitable for your specific circumstances, will achieve your intended outcomes, or will be deemed valid in all legal proceedings. You use our service at your own risk and are responsible for determining its suitability for your needs.

Important: These limitations of liability reflect the allocation of risk between WUHLD and you. The pricing of our service reflects these limitations, and you acknowledge that without these limitations, we would not be able to offer our service at the current price. If you require greater protection, we recommend seeking professional legal advice.

Indemnification

You agree to indemnify and hold harmless WUHLD, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal fees, arising out of or in any way connected with your access to or use of our service.

Modifications to Terms

We may modify these Terms of Service at any time by posting the revised terms on our website. Your continued use of our service after such changes constitutes your acceptance of the revised terms.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the United Kingdom.

Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
